Immaware of those criticisms over rights to privacy, I just disagree with them.
Historically, women have always aborted when necessary and we will continue to do so. It's no one's damn business.
And yes, there hasn't been much attempt to codify abortion law after Roe. Why would there be? The Supreme Court already determined it to be an issue protected by privacy rights. The only laws to be made are regulatory ones, and there have been those.
I was talking about before, on a federal level. There were different state laws, of course. For example, once the Dobbs decision came down, it triggered an anti-abortion law from the 1860s here in Arizona.
Like with slavery laws, long term it's too destructive to have rights and freedoms in one state but lose them 5 miles down the road because you crossed a state border. The confederation of independent states under a republic stands because of free and clear interstate travel and trade. You cannot have that when you have different classes of citizens from one state to another.
Roe recognized that, amongst other things via rights of privacy.
